To ensure accuracy and compliance, in most counties we are able to obtain an address or SSN as a third identifier for most common name searches. Addresses are typically found in associated civil judgments for unpaid court fees and fines. Obtaining a third identifier is a must for common surnames like Williams, Brown, Johnson, Martinez, and Smith.

Our standard search covers a minimum of 7 years, with extended requests available for an additional fee. Court fees are prepaid by us and invoiced at cost.

New York’s Office of Court Administration (OCA)

Historically many NY counties (mostly downstate) required local searches to be performed via the OCA at $95 per name. In November 2023 the OCA expanded this policy to include searches in New York’s 4th Judicial District.

Our firm contested this decision, resulting in the policy’s reversal in February 2024.

Specifically, New York’s Judiciary Law § 255 obligates clerks to conduct searches upon request, with fees specified in CPLR Article 80. In addition a 2022 appellate court decision (Herrick v. Town of Colonie) stipulated that a public official is duty-bound, irrespective of the presence of a docket number, to search for and make accessible public records of the court they serve.

As a direct result of our actions, on February 14th, 2024 the NY Office of Court Administration reversed its 2023 decision and issued a directive mandating court clerks across New York conduct record searches using a name and date of birth (if they do not already provide a public record index). The directive can be downloaded here.

The directive not only reversed the policy in New York’s 4th Judicial District but for other previously OCA only counties as well.

Diligent Data Services has been able to request searches in many of these previously OCA only counties. The standard court fee for these searches is $5 for every two years searched.
